TERMS OF SERVICE – BOAT MAINTENANCE MEMBERSHIP
1. Acceptance of Terms
By subscribing to our boat maintenance membership services, you agree to these Terms of Service, which form a legally binding agreement between you and GD Nautical Services LLC (DBA New Sun Marine), registered in the states of Florida and Montana (MN), with headquarters at 17301 Biscayne Blvd, ZIP 33160.
2. Service Description
Membership includes recurring boat maintenance services such as engine checks, oil changes, system diagnostics, cleaning, hull inspections, and more, depending on the plan selected.
3. Membership Plans & Payments
Subscriptions are available monthly, quarterly, or annually, billed via ACH, Credit Card, PayPal. Memberships auto-renew unless canceled before the renewal date.
4. Boat Location & Access
- The customer must provide accurate location details of the vessel, including marina/dock address, slip number, and access instructions.
- If the vessel is relocated, the customer must notify GD Nautical Services LLC (DBA New Sun Marine) at least 72 hours before the next scheduled service.
- Failure to provide access to the vessel at the time of service may result in service delays or cancellation, with no refund.
5. Insurance & Liability
- Customers are required to maintain an active insurance policy on their vessel covering damage, theft, and liability.
- GD Nautical Services LLC (DBA New Sun Marine) is not liable for any pre-existing conditions or damages not caused by our staff.
- While we take all reasonable care, we are not responsible for:
- Damage due to poor boat condition or lack of maintenance;
- Damage resulting from acts of nature (e.g., storms, flooding);
- Third-party interference or negligence unrelated to our service.
6. Customer Responsibilities
Customers agree to:
- Keep payment information up to date;
- Ensure boat is accessible and safe for service;
- Notify us of any known issues or restrictions.
7. Cancellations and Refunds
- Cancel within 7 days for a full refund;
- After 7 days, cancellations will stop future billing but no refunds are issued for unused periods;
- Services missed due to customer inaccessibility are non-refundable.
8. Modifications
We may update these Terms at any time. Notice of material changes will be provided via email or our website.
9. Governing Law
These Terms shall be governed by the laws of the State of Florida, United States.
